An Intra-company visa allows an employee to come to the UK to do their job at their employer’s UK branch.

There are 2 types of Intra-company visas:

Intra-Company Transfer Visa

You should apply for this visa if your employer is transferring you to a role in the UK. Before you apply for this visa route, you will have to show that you have worked for your employer for more than 12 months, however you do not need to show this if your employer will be paying you £73,900 or more a year to work in the UK.

The duration you can stay in the UK with this visa depends on each individual case. Usually the rule is that you can stay the shorter duration of:

  • 5 years.
  • The time given on your Certificate of Sponsorship plus 14 days.
  • The maximum total stay allowed for this visa – which is:
    • 5 years in any 6-year period if you are paid less than £73,900 a year.
    • 9 years in any 10-year period if you are paid £73,900 a year or more.

 

Intra-Company Graduate Trainee Visa

You should apply for this visa if your employer is transferring you to the UK as part of a graduate training programme for a specialist role. Before you apply for this visa route, you will have to show that you have worked for your employer for more than 3 months immediately before you apply.

The duration you can stay in the UK with this visa depends on each individual case. Usually, the rule is that you can stay the shorter duration of:

  • 12 months.
  • The time given on your Certificate of Sponsorship plus 14 days.
  • The maximum total stay allowed for this visa.

 

To qualify for this visa route, you must demonstrate:

  1. You are an existing employee of an organisation that has been approved by the Home Office.
  2. You have a ‘Certificate of Sponsorship’ from your employer which includes information about the job role you have been offered.
  3. You are travelling to the UK to do a job that is on the Home Office list of eligible occupations.
  4. You are paid at least £41,500 for an Intra-Company Transfer Visa or at least £23,000 for an Intra-Company Graduate Visa.

Applying from outside the UK

If you are applying from outside the UK, once you have provided your identity and provided your documents, you will usually get a decision within 3 weeks.

 

Applying from inside the UK

If you are applying from inside the UK, you will get a decision within 8 weeks of your application date.

There are some limitations of this visa category.  Please note that you cannot apply for benefits, apply to settle permanently in the UK or change jobs unless you apply to update your visa.

DO

  • Make sure you have a valid Certificate of Sponsorship from your employer.
  • Make sure you have evidence to prove that you meet the English language requirement.
  • Make sure you meet the financial salary requirements under your chosen route.
  • Ensure that your employer has been listed under the Home Office Approved Employers.

DON’T

  • Do not underestimate the complexity of this application.
  • Do not forget to prepare the correct evidence you need.
  • Do not forget a detailed cover letter to accompany your application.
  • Do not fail to pay the application fee and the healthcare surcharge.
  • Do not fail to prove that you meet the financial requirements.
  • Do not forget to book an appointment after submitting your application.
